Channel Terms & Conditions

1. Introduction

These Channel Terms & Conditions ("Channel Terms") govern the creation, management, and subscription to channels within the CringeAI application ("App"). By creating a channel or subscribing to a channel, you agree to be bound by these Channel Terms in addition to our general Terms of Service and Privacy Policy.

2. Channel Creator Terms

2.1 Eligibility

To create a channel on CringeAI, you must:

• Be at least 18 years of age
• Have a valid CringeAI account in good standing
• Complete the Stripe Connect onboarding process for payment processing
• Provide accurate and complete information during registration

2.2 Content Responsibilities

As a channel creator, you are solely responsible for:

• All content you upload, stream, or share on your channel
• Ensuring your content does not violate any applicable laws or regulations
• Ensuring your content does not infringe on any third-party intellectual property rights
• Accurately describing your subscription tiers and the content/benefits subscribers will receive
• Delivering the content and benefits promised to your subscribers

2.3 Prohibited Content

Channel creators may not upload or share content that:

• Contains sexually explicit or pornographic material
• Promotes violence, hatred, or discrimination
• Contains illegal content or promotes illegal activities
• Infringes on copyrights, trademarks, or other intellectual property rights
• Contains malware, viruses, or harmful code
• Harasses, bullies, or threatens other users
• Contains misleading or deceptive information
• Violates the privacy of others

2.4 Revenue and Payments

By accepting these terms, you acknowledge that:

• You are responsible for any applicable taxes on your earnings
• Stripe's terms of service apply to all payment processing
• Refunds issued to subscribers may be deducted from your earnings
• CringeAI reserves the right to withhold payments in cases of suspected fraud or terms violations

2.5 Channel Termination

CringeAI reserves the right to suspend or terminate any channel that:

• Violates these Channel Terms or our general Terms of Service
• Receives multiple valid complaints from subscribers
• Fails to deliver promised content or benefits
• Engages in fraudulent or deceptive practices

3. Subscriber Terms

3.1 Subscription Agreement

By subscribing to a channel, you agree to:

• Pay the recurring subscription fee for your selected tier
• Automatic monthly renewal until you cancel
• The specific terms and benefits described by the channel creator

3.2 Payment Terms

Subscription payments are processed through Stripe. By subscribing, you acknowledge:

• Your payment method will be charged immediately upon subscription
• Subscriptions automatically renew monthly on the same date
• You can cancel your subscription at any time through the app
• Cancellation takes effect at the end of the current billing period
• No partial refunds are provided for unused portions of a subscription period

3.3 Refund Policy

Refunds may be issued at CringeAI's discretion in the following circumstances:

• Technical errors resulting in duplicate charges
• Channel termination by CringeAI for terms violations
• Significant failure by the creator to deliver promised content

Refund requests must be submitted within 14 days of the charge. To request a refund, please contact support.

3.4 Subscriber Conduct

Subscribers agree not to:

• Share, redistribute, or resell subscription content
• Use automated tools to download or scrape content
• Harass, threaten, or abuse channel creators
• Attempt to circumvent subscription requirements
• Share account credentials with others

4. Subscription Tiers

Channels may offer up to three subscription tiers:

• Basic: Entry-level subscription with access to subscriber-only content
• Premium: Mid-tier subscription with additional benefits as defined by the creator
• VIP: Highest tier with maximum benefits as defined by the creator

The specific content and benefits for each tier are determined by the channel creator. Please review the tier descriptions carefully before subscribing.

5. Intellectual Property

Channel creators retain ownership of their original content. By uploading content to CringeAI, creators grant CringeAI a non-exclusive, worldwide license to host, display, and distribute the content to subscribers and for promotional purposes.

Subscribers receive a limited, personal, non-transferable license to view subscription content for personal, non-commercial use only.

6. Disclaimers

CringeAI acts as a platform connecting creators and subscribers. We do not:

• Guarantee the quality, accuracy, or completeness of channel content
• Endorse any channel creator or their content
• Guarantee any specific results from consuming channel content
• Take responsibility for disputes between creators and subscribers

Channel content is provided "as is" without warranties of any kind.

7. Limitation of Liability

To the maximum extent permitted by law, CringeAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use channel features
• Any content posted by channel creators
• Any conduct of channel creators or subscribers
• Unauthorized access to or alteration of your data

8. Changes to Terms

CringeAI reserves the right to modify these Channel Terms at any time. We will notify users of material changes through the app or via email. Continued use of channel features after changes constitutes acceptance of the modified terms.

9. Governing Law

These Channel Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
